Terms of Service

These Terms of Service ("Terms") govern your use of BANTAY, the software-as-a-service platform available at bantayhse.com and app.bantayhse.com ("the Service"), operated by BANTAY ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

BANTAY provides tools for recording, managing and reporting workplace health, safety and environment (HSE) information, including observations, toolbox talks, permits, incidents, inspections, training records, and related analytics and AI-assisted features.

2. Your account

• You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
• Each organization (workspace) is an isolated tenant. The organization owner controls membership, seats and organization-level settings.
• You must be authorized by your organization to record HSE data on its behalf.

3. Plans, trials and billing

• Plan features, limits and prices are described on our pricing page. Prices are in UAE Dirhams (AED) unless stated otherwise.
• New organizations receive a free trial of paid features. When a trial ends, the account continues on the Free plan — data is retained, and paid modules re-open on upgrade.
• Paid subscriptions renew monthly or annually. Payments may be processed by our merchant-of-record payment partner; their checkout terms apply to the payment transaction.
• If a subscription lapses, the workspace reverts to the Free plan. We do not delete your records because of non-payment.

4. Acceptable use

• Do not use the Service for unlawful purposes, to infringe others' rights, or to attempt to access other tenants' data.
• Do not resell, reverse-engineer, or interfere with the operation or security of the Service.
• AI features are subject to fair-use quotas shown in the app.

5. Your data

• Records created in a workspace belong to the organization that owns the workspace. When a member leaves an organization, records they created while a member remain with that organization.
• We process personal data as described in our Privacy Policy.
• You can export your data from the app. On written request after account closure, we will delete your organization's data within a reasonable period, subject to legal retention duties.

6. Important disclaimer — professional responsibility

BANTAY is a record-keeping and reporting tool. It does not replace professional HSE judgment, statutory duties, or legal obligations under applicable law (including UAE Federal Decree-Law No. 33 of 2021 and related regulations). You remain solely responsible for workplace safety decisions, regulatory compliance and the accuracy of the data you record. AI-generated content must be reviewed by a competent person before use.

7. Availability and changes

We aim for high availability but the Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We may improve or modify features over time; material reductions to a paid plan will be communicated in advance.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claims arising out of or relating to the Service is limited to the amounts you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental or consequential damages, or for loss of profits, data or goodwill.

9. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate accounts that materially breach these Terms, with notice where practicable.

10. Governing law

These Terms are governed by the laws of the United Arab Emirates. Disputes are subject to the exclusive jurisdiction of the courts of the Emirate of Abu Dhabi, UAE.
